Picture Mosaics offers an online photo mosaic and video mosaic creation tool through their website (http://www.picturemosaics.com), free to use with the creation of an account. A valid email address is required to create an account. Picture Mosaics reserves the right to delete or remove any accounts or projects at their sole discretion. Reasons for removal or deletion can include, but are not limited to, inactivity and unlawful or abusive content. Picture Mosaics does not offer a long-term photo hosting service and shall not be held liable for photos or projects removed from our database at any time.
Users are given the option to make their mosaics public, semi-public, or private. Public mosaics may be accessed, viewed, shared, printed, downloaded, or purchased by anyone. Semi-public mosaics may be accessed, viewed, and shared by anyone, but only the original user may purchase or download the mosaic. Private mosaics may be accessed, viewed, printed, downloaded or purchased by the user only.
Users are prohibited from uploading any images of which they do not own the rights or images depicting any unlawful activity. Picture Mosaics shall not be made liable for any damage to user resulting from nonobservance of this agreement. The user is solely responsible for obtaining the permission to use or rights of the photos they upload.
Users are given the option to delete their accounts. When a user chooses this option, their account will be marked for deletion and immediately removed from the Picture Mosaics website. The account will be permanently deleted from the server by Picture Mosaics within a reasonable timeframe.
Users are also given the option to delete their individual projects. When a user chooses this option, the project will be marked for deletion and immediately removed from the Picture Mosaics website. The project will be permanently deleted from the server by Picture Mosaics within a reasonable timeframe.
Digital Licensing
As part of the Online Mosaic Tool, users are given the option to purchase full resolution digital files (JPG, PNG, TIF) as well as video mosaic files in SD (720x404), HD (1920x1080), and 4K (3840x2160) with licensing options for each. Each license and its permissions are described below:
For purposes of this agreement, "use" means to copy, reproduce, modify, edit, synchronize, perform, display, broadcast, publish, or otherwise make use of.
The Online Mosaic Tool: Embedded Zoomable Mosaics
As part of the Online Mosaic Tool, users are given the option to embed the zoomable mosaic personal websites at no cost. To embed your mosaic at no cost and be compliant with these terms, the mosaic must maintain all logos and links that exist in the lower right hand corner. If these elements are altered, hidden, or removed, the mosaic and your account are in violation of these terms. If the zoomable mosaic is to be placed on a commercial or corporate website, a $2000 USD fee per year is required as long as the mosaic is embedded. If you are a reseller, the $2000 fee is also applicable. If features (submission flow, search, etc.) are purchased for your project and total $2000 or more, this $2000 fee is waived. If the mosaic is not publicly available (i.e. is behind a user login screen, intranet, etc.), a White Label License must be purchased. When embedded, the total number of simultaneous users accessing the mosaic cannot exceed 1500 otherwise the mosaic may become inaccessible, or slow to load for users, during the time period that there are more than 1500 simultaneous users. If support for more than 1500 simultaneous users is needed, please contact us to discuss migrating your mosaic to a higher-end server environment.
The Online Mosaic Tool: Repurposing Embedded Mosaics
Embedded mosaics created through the Online Mosaic Tool will have their Collaboration and Interactive Dashboard deactivated after their submission period has ended. The end of the submission period is determined by a number of factors, including but not limited to, the lack of submission activity over a period of time. The mosaic will still be interactive and have all of the features purchased, but repurposing or recycling the project for a new source image or new activation will require a $1200 fee. The Online Mosaic Tool: White Label Licensing
Through the Online Mosaic Tool, embedded mosaics can be white labeled through the purchase of a White Label License or an Integrator License. Licensing can be for a 3 month, 6 month, 1 year term, and can be extended as necessary. Please contact us here to obtain pricing.
The Online Mosaic Tool: Integration and Embedding within Virtual Event Platforms
Picture Mosaics has direct integrations with many event platforms, as such, in order to use an embeddable mosaic with or in conjunction with an event platform (examples: Hopin, Swapcard, Hublio), Picture Mosaics is required to work directly with the platform vendor to allow for appropriate, secure integration and optimal usage. Examples of event platforms are Hopin, Swapcard, Hublio. Please contact Picture Mosaics to arrange an integration meeting to inquire about integration or to verify if the Picture Mosaics' platform is already integrated. If an embeddable mosaic is integrated within an event platform without Picture Mosaics integration, it is a violation of usage and your account can be suspended.
The Online Mosaic Tool: Use, Implementation, and Violations
Users and administrators implementing and deploying Embedded Zoomable Mosaics must abide by the tools and features available through the Online Mosaic Tool. Attempting to bypass, spoof referrer, improperly embed, inject data without use of the API, or other malicious actions will not be tolerated and will result in disabling the project and account. The system will automatically flag these violations and inform Picture Mosaics of each occurrence. Picture Mosaics, at its discretion, will review each violation and determine the course of action for the project and account in violation, which can include, and it is not limited to, the disabling and removal of the project and account
The Online Mosaic Tool: Content
All content (information, images, pictures, data, text, photographs, graphics, messages, or other materials), referred to as "Content," that you upload, submit, display, or use via our Services is your property. We do not claim any ownership rights to your Content. This includes everything you share through our Services (like your images, shop names, customer reviews, comments, videos, usernames, etc.).
Responsibility for the Content
You are fully responsible for any Content you post through the services Picture Mosaics provides. By posting, you confirm that you have the necessary rights to the Content and that it does not infringe on any third party's rights.
Permission to Use the Content
By using our services, you acknowledge that Picture Mosaics respects your ownership of the Content. We will not use your Content without your explicit permission.
Rights You Grant to Picture Mosaics
By uploading Content, you grant Picture Mosaics a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable, and perpetual license to use, display, edit, modify, reproduce, distribute, store, and create derivative works from your Content to provide the Services and promote Picture Mosaics and/or your Picture Mosaics store, or the Services in general, in any formats and through any channels, including across any Picture Mosaics services, third-party websites, advertising mediums, and social media platforms. You have the option to set your projects to private at any time, ensuring that your projects are not publicly viewable or accessible. This gives you control over who can see your content and how it is shared.

Reporting Unauthorized Content
Picture Mosaics respects intellectual property rights and adheres to intellectual property laws. We follow appropriate legal procedures to remove any infringing content from our Services.
Intellectual Property
We respect your creative rights and encourage you to express your ideas. Similarly, we ask you to respect the intellectual property rights of others. You must own the Content you upload to Picture Mosaics or have explicit permission to post it. All Content must comply with relevant publicity rights, trademark and copyright laws, and all other applicable state and federal regulations.
Trademarks and Intellectual Property Infringement
When we receive valid notifications of intellectual property infringement, Picture Mosaics acts promptly to remove, block, or disable access to the allegedly infringing material. We will attempt to contact the party responsible for the infringing Content, inform them of the notice and removal, and provide information about counter notifications in cases of confirmed copyright infringement.
Counter DMCA Notifications
Picture Mosaics will review any requests or notices indicating that copyrighted content exists in a user's project. If we determine that the content violates copyright laws, we will remove the infringing content. If Picture Mosaics receives a counter notification under the DMCA, we will review the counter notice and may restore the removed material if it is found to be non-infringing, unless the copyright owner takes legal action seeking a court order against the allegedly infringing party and informs Picture Mosaics of this action. A copy of the counter notice will be sent to the original complaining party.
Repeat Infringement
We may terminate the accounts of users who are subject to repeated notices of intellectual property infringement, as deemed appropriate by Picture Mosaics.
Copyright Responsibility
By accepting this Agreement and using our Services, you affirm that you own all necessary rights (including copyrights) for the Content you post, or that you have explicit authority and written permission to use the Content. If you believe Content that you own has been posted without your permission and wish to have it removed, please contact our customer service department for further assistance. If your Content is found to infringe on another's intellectual property rights, we reserve the right to block it at our discretion.
Inappropriate, False, or Misleading Content
Certain types of Content are not allowed on our Services for legal reasons or otherwise. You agree not to post any Content that is abusive, threatening, defamatory, obscene, vulgar, illegal, or otherwise offensive or in violation of this Agreement. Additionally, you agree not to post any Content that is false, misleading, or uses the Services in a fraudulent or deceptive manner.

Force Majeure
Picture Mosaics shall not be liable for any failure of or delay in the performance of this Agreement for the period that such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes or labor disputes, embargoes, government orders or any other force majeure event.

Picture Mosaics reserves the right to update or modify these terms to further protect our clients, their information, and our company.
